Community Guidelines & Conduct Policy

1. Introduction & Purpose

1.1 Overview of the Community Guidelines

These Community Guidelines ("Guidelines") govern the conduct, content, and participation of all members of the Swing Stock Strategy Group community (the "Community"), including but not limited to Discord servers, live calls, webinars, chat channels, forums, and any other digital platforms operated by Swing Stock Strategy Group, LLC ("the Company"). By joining, accessing, or participating in the Community, you agree to be legally bound by these Guidelines, as well as the Company's Terms & Conditions, Risk Disclosure Statement, Refund & Billing Policy, Privacy Policy, and Earnings Disclaimer, which are incorporated by reference.

1.2 Legal Status & Binding Nature of the Guidelines

These Guidelines form a binding agreement between you and the Company. Your access to and participation in the Community is conditioned upon your acceptance of, and compliance with, these Guidelines. Violation of these Guidelines may result in immediate suspension or termination of access without prior notice and without refund.

1.3 Relationship to Other Policies

These Guidelines are intended to work in conjunction with and supplement the Company's Terms & Conditions, Risk Disclosure Statement, Refund & Billing Policy, Privacy Policy, and Earnings Disclaimer. In the event of any conflict, the Terms & Conditions shall prevail. All provisions shall be read together to form a unified legal agreement.

1.4 Mandatory Acknowledgment of Guidelines

All users must acknowledge and agree to these Guidelines at registration or first access. Access is conditional upon explicit acceptance. The Company retains records of acknowledgment as proof of acceptance. Continued participation constitutes ongoing consent.

1.5 Private Forum Statement — No Public Forum Rights

The Community is a private membership forum. Participation is a privilege, not a right. Members have no expectation of public forum protections or First Amendment rights within the Community. The Company may remove content, moderate discussions, and revoke access without obligation to provide justification or prior warning.

1.6 Company's Right to Amend Guidelines

The Company may amend, modify, or replace these Guidelines at any time. Modifications are effective upon posting. Continued participation after modifications constitutes acceptance.

1.7 Effective Date and User Consent

These Guidelines are effective as of the date above and remain in force until amended or replaced. By accessing or participating in the Community, you acknowledge you have read, understood, and agreed to be legally bound by these Guidelines and all incorporated policies.

2. Membership & Access Rights

2.1 Eligibility Requirements

Access is limited to individuals at least eighteen (18) years of age or the age of majority in their jurisdiction, whichever is greater, with legal capacity to enter a binding agreement.

2.2 Account Ownership, Responsibility & Security

Each account must be registered to a single, identifiable individual. You are responsible for safeguarding credentials and all activity under your account. Account sharing, sublicensing, or unauthorized access is prohibited.

2.3 Termination and Suspension of Access

The Company may suspend, restrict, or permanently terminate access at any time, with or without notice, for violations of these Guidelines, incorporated policies, or applicable law. Termination may occur without refund, credit, or compensation.

2.4 Non-Transferability of Membership

Membership is personal and non-transferable. Any attempted transfer or sublicensing results in immediate termination without refund.

2.5 Consequences of Rule Violations on Access and Billing

Violations may result in suspension or termination. Such termination does not entitle the member to a refund or prorated credit. Billing and refunds are governed by the Refund & Billing Policy.

2.6 Educational Purpose & Non-Investment Advisory Relationship

Membership does not establish a fiduciary, advisory, client, or investment management relationship. No aspect of membership grants the right to receive financial, investment, legal, or tax advice.

2.7 Sanctions & Export Controls

You represent you are not located in, under control of, or a national/resident of any country or person subject to U.S. sanctions and are not on any U.S. denied-party lists. Access may be restricted to comply with sanctions and export control laws.

3. General Code of Conduct

3.1 Standards of Behavior & Core Community Values

Members must act professionally, respectfully, and responsibly, contributing constructively to an educational environment.

3.2 Respectful and Civil Discourse

Harassment, hate speech, abusive language, threats, personal attacks, or discriminatory behavior is prohibited.

3.3 Zero Tolerance for Harassment, Bullying, Hate Speech

Any such conduct may result in immediate suspension or permanent removal without prior notice or refund.

3.4 No Expectation of Privacy in Community Communications

Communications within the Community are not private. The Company may access, monitor, archive, or review content to enforce these Guidelines or comply with law. For clarity, while member communications are not private, proprietary Company content remains confidential per §6.4.

3.5 Responsibility for One's Own Posts and Conduct

Members are legally and financially responsible for their own statements, posts, uploads, and conduct. The Company is not responsible for user communications or actions.

3.6 Moderator Authority and Final Say

Moderators and administrators have full authority to enforce these Guidelines, remove content, mute participants, and suspend or terminate access. Moderator decisions are final, subject to §7.4.

4. Prohibited Content & Activities

4.1 Strict Prohibition on Financial or Investment Advice

Members are prohibited from providing or implying financial, investment, legal, tax, or trading advice. All content must be educational in nature only.

4.2 No Trade Alerts, "Signal" Services, or Pump-and-Dump Behavior

Members may not offer, promote, or distribute trade alerts or "signals," or coordinate market activity. "Signal" includes any real-time or near-real-time callouts of entries, exits, stops, targets, or portfolio allocations intended to prompt trades. Pump-and-dump, insider trading, front-running, or other manipulative activity is prohibited and may be reported to authorities.

4.3 No Investment Solicitation, Paid Promotions, or Self-Promotion Without Approval

No investment solicitation, paid services, product promotion, or commercial activity without prior written consent.

4.4 Prohibition on Fraudulent, Illegal, or Unethical Activities

No use of the Community for fraudulent, unlawful, or unethical activity or to violate securities laws, including SEC and FINRA regulations.

4.5 No Impersonation, False Representation, or Identity Abuse

No impersonation or misrepresentation of identity or affiliation. Violations may be referred to law enforcement or regulators.

4.6 Prohibition on Sharing Proprietary or Confidential Materials

No copying, recording, distributing, or sharing Company proprietary materials or other members' proprietary content without express written consent.

4.7 Prohibited Use of AI Tools or Bots for Market Manipulation

No use of AI, algorithms, bots, or automation to engage in or facilitate illegal or manipulative market activity.

4.8 No Pooled Funds, Profit-Sharing, Managed Accounts, or Private Placements

Members may not solicit or accept funds for pooled trading, offer profit-sharing or managed-account arrangements, or solicit investments in private placements or securities offerings.

4.9 Automated Access & Scraping Prohibited

Unauthorized bots, scrapers, or automated means to access, copy, or extract Community or Company content are prohibited.

5. Information Sharing & Liability Disclaimers

5.1 Educational Use Only — No Professional Advice

All content is educational and informational. No statements by the Company, moderators, employees, contractors, or members constitute professional advice.

5.2 User Responsibility for Verifying Information

Members must independently verify any information obtained within the Community. The Company does not warrant accuracy or completeness of user-generated content.

5.3 Company Disclaimer of Liability for User-Generated Content

Reliance on any information in the Community is at members' own risk. The Company disclaims liability arising from user content.

5.4 Reporting Misleading or Dangerous Information

Members must report misleading, inaccurate, fraudulent, or harmful content through designated channels. The Company may remove such content and take enforcement action.

5.5 SEC / FINRA / FTC Regulatory Compliance Statement

The Company operates as an educational organization and is not an investment advisor, broker-dealer, or financial institution. All Community activity must comply with applicable laws, including SEC, FINRA, and FTC regulations.

6. Intellectual Property & Content Ownership

6.1 Company-Owned Content — License Terms

All educational materials, videos, written materials, trade examples, curriculum, and other intellectual property provided by the Company are owned by Swing Stock Strategy Group, LLC. Members receive a limited, revocable, non-transferable, non-sublicensable license for personal, non-commercial use only.

6.2 User-Generated Content — Limited License to Company

By posting or sharing content in the Community, members grant the Company a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, distribute, display, and adapt such content for moderation, community management, marketing, and operational purposes, subject to law. This license includes the right to use the member's display name, likeness, and statements as they appear with such content, subject to the Privacy Policy.

6.3 No Unauthorized Recording, Reposting, or Redistribution

Recording, screenshotting, screen capturing, copying, reposting, or redistributing any part of the Community (including educational materials, live calls, chat discussions, or course content) is prohibited. Violations may result in termination and legal action.

6.4 Confidentiality of Educational & Proprietary Material

Members must maintain confidentiality of all educational and proprietary materials shared within the Community. Unauthorized sharing outside the Community is a material breach.

6.5 DMCA & Copyright Violation Procedures

The Company complies with the DMCA. Designated DMCA Agent: swingstockstrategygroup@gmail.com; 2962 Par 5 Trail, Woodbine, IA 51579. The Company may remove infringing content and suspend or terminate the offending member's access.

7. Community Moderation & Enforcement

7.1 Moderator Authority & Enforcement Powers

Moderators and administrators may monitor, review, and remove content; issue warnings; mute; and suspend or permanently terminate access at their discretion.

7.2 Grounds for Warnings, Suspensions, and Permanent Bans

Violations of these Guidelines, the Terms & Conditions, or any incorporated policy may result in warnings, temporary suspension, or permanent termination.

7.3 Immediate Ban Triggers

Immediate and permanent removal without prior warning or refund may occur for:

  • (a) Harassment, threats, or hate speech;
  • (b) Financial solicitation or promotion of investment schemes;
  • (c) Illegal activity, including market manipulation;
  • (d) Sharing or distributing Company IP;
  • (e) Fraudulent activity or impersonation;
  • (f) Repeated violations after prior warnings.

7.4 Ban Appeal Procedure

Permanently banned members may submit a written appeal within ten (10) business days of the ban notice via the official support channel. Decisions on appeals are final as an internal Community matter and do not create a right to reinstatement. Nothing herein waives either party's rights under Section 13.

7.5 Moderator Protection & Indemnification

Members agree to hold harmless, indemnify, and release moderators, administrators, and Company representatives from claims, damages, liabilities, or costs arising from good-faith moderation or enforcement. This protection is in addition to indemnification obligations in the Terms & Conditions.

7.6 No Obligation to Provide Warnings Prior to Enforcement

The Company may act immediately upon any violation at its sole discretion.

7.7 Company's Right to Deny Access at Sole Discretion

The Company may deny or revoke access at any time, with or without cause, and without obligation to provide an explanation. Access revocation for violations does not entitle the member to refunds or credits. See the Refund & Billing Policy.

8. User Responsibilities & Liability

8.1 Personal Responsibility for Trading & Financial Decisions

Members are solely responsible for their own trading and financial decisions. The Company does not guarantee or assume responsibility for any trades, investments, or actions taken by members.

8.2 Waiver of Claims Against the Company & Moderators

Members release, discharge, and hold harmless the Company, its officers, employees, contractors, moderators, and affiliates from claims, damages, liabilities, losses, or costs arising from participation or reliance on information shared.

8.3 Indemnification of Company, Owners, and Staff

Members agree to indemnify, defend, and hold harmless the Company, its officers, employees, contractors, moderators, and affiliates against claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of (a) Community participation; (b) violation of these Guidelines or incorporated policies; or (c) actions or omissions.

8.4 Release of Liability for User-to-User Interactions

The Company is not responsible for user-to-user interactions, whether online or offline. Members engage at their own risk.

8.5 Assumption of Risk Statement

Members acknowledge inherent financial risk and waive claims against the Company for losses or damages arising from trading and investment decisions.

9. Privacy, Data & Security

9.1 Respect for Members' Personal Information

Members must respect others' personal information. Unauthorized sharing of personal data is prohibited and may result in termination.

9.2 Prohibition on Doxxing or Disclosure of Private Data

Doxxing, stalking, or intentional disclosure of private information is prohibited and grounds for immediate permanent ban.

9.3 No Expectation of Privacy — Internal Logging of Activities

Communications may be logged, monitored, or archived for policy enforcement, legal compliance, and regulatory cooperation.

9.4 Platform Monitoring for Compliance & Enforcement

The Company may monitor all Community channels and activity via automated tools, manual review, or third-party services, consistent with law.

9.5 Cooperation with Law Enforcement & Regulators

The Company may cooperate with SEC, FINRA, FTC, DOJ, and other authorities in the investigation of suspected illegal or fraudulent activity, including disclosure of relevant user information and logs.

9.6 Privacy Compliance

Processing of personal data is governed exclusively by the Company's Privacy Policy, which describes collection, use, retention, lawful bases, data subject rights (including CCPA "Do Not Sell or Share" and GDPR requests), and contact methods. Community logging in §§9.3–9.5 is performed on those bases.

10. Community Channels & Acceptable Use

10.1 Discord Server & Communication Channels Overview

The Community includes Discord servers, chat channels, forums, voice rooms, and live webinar sessions. All participation is subject to these Guidelines and incorporated policies.

10.2 Posting Standards — Charts, Screenshots, Educational Resources

Shared content must be relevant, accurate, respectful, and educational. Provide context for charts/screenshots and avoid misleading information.

10.3 Voice, Video & Webinar Etiquette

Members must conduct themselves professionally, avoid disruptions, and follow moderator instructions.

10.4 External Link & Resource Sharing Rules

Links must be relevant to educational objectives. Spam, referral/affiliate promotions, or malicious URLs are prohibited.

10.5 Spam, Flooding & Disruption Prohibitions

Spamming, flooding, or intentionally disrupting discussions or live sessions is prohibited and may lead to immediate suspension or termination.

10.6 Content Removal Rights

The Company may remove, edit, or restrict any content for any reason, including violations, compliance needs, or to maintain a respectful and secure environment. Decisions are final.

11. Reporting & Escalation Procedures

11.1 How to Report Violations or Concerns

Members may report violations or concerns through official reporting channels. Reports must be in good faith with sufficient detail.

11.2 Confidentiality of Reports & Protection Against Retaliation

The Company will make reasonable efforts to maintain reporter confidentiality as permitted by law. Retaliation is prohibited.

11.3 Review & Response Timeline

Reports will be reviewed promptly. The Company will determine the appropriate response at its sole discretion.

11.4 Escalation for Serious Legal or Safety Issues

Reports involving threats, harassment, fraud, securities violations, or other serious issues may be escalated to authorities. Credible threats of violence or self-harm will be referred immediately to appropriate authorities.

11.5 Cooperation with Law Enforcement and Regulators

The Company may cooperate with authorities in connection with investigations and may disclose member information, communications, and activity logs as permitted or required by law.

12. Legal Disclaimers & Limitations of Liability

12.1 No Financial, Legal, or Professional Advice

The Company and its representatives, moderators, employees, contractors, or affiliates do not provide financial, legal, investment, or tax advice. All content is educational and informational only.

12.2 Educational Purpose and User Risk Acceptance

Actions taken based on Community information are made voluntarily and at members' own risk. No financial outcomes, earnings, or performance results are guaranteed.

12.3 Limitation of Company Liability for User Behavior

The Company is not liable for members' conduct, statements, content, or actions.

12.4 Limitation of Liability for Platform Outages or Third-Party Tools

The Company is not liable for damages, losses, or claims from technical failures, outages, or interruptions caused by third-party platforms or tools, including Discord.

12.5 No Warranty of Results or Earnings

No express or implied warranties regarding information accuracy, completeness, or usefulness. No guarantee of profits or results. Trading involves substantial risk of loss.

13. Dispute Resolution & Governing Law

13.1 Internal Dispute Resolution Process

Members must first submit disputes through the Company's internal process via the designated support channel. The Company will attempt to resolve the issue in good faith.

13.2 Mandatory Binding Arbitration Agreement

Unresolved disputes, claims, or controversies shall be resolved exclusively through final and binding arbitration before a single neutral arbitrator under the AAA Commercial Arbitration Rules. Parties waive the right to a jury trial and court proceedings.

13.3 Waiver of Class Action or Collective Claims

All claims must be brought individually. The arbitrator has no authority to consolidate claims or preside over class or representative actions.

13.4 Governing Law & Exclusive Venue

These Guidelines and any disputes hereunder are governed by the laws and venue specified in the Company's Terms & Conditions. In the event of any inconsistency, the Terms & Conditions control.

13.5 Prevailing Party Attorney's Fees Clause

In any arbitration arising from or relating to these Guidelines, the prevailing party may recover reasonable attorneys' fees and costs to the fullest extent permitted by law and arbitration rules.

14. Severability, Enforcement & Updates

14.1 Severability Clause

If any provision is held invalid, unlawful, or unenforceable, it shall be severed and the remainder shall continue in full force and effect.

14.2 No Waiver of Enforcement Rights

Failure to enforce any provision shall not be a waiver of future enforcement. No waiver is effective unless in writing and signed by an authorized Company representative.

14.3 Entire Agreement & Hierarchy of Legal Documents

These Guidelines, together with the Terms & Conditions, Risk Disclosure Statement, Refund & Billing Policy, Privacy Policy, Earnings Disclaimer, and other incorporated agreements, constitute the entire understanding regarding Community participation. In any conflict, the Terms & Conditions control, followed by these Guidelines and other policies.

14.4 Right to Amend Guidelines at Any Time

The Company may amend these Guidelines at any time. Updates are effective upon posting. Continued participation constitutes acceptance.

14.5 User Acknowledgment of Continued Consent After Updates

Remaining a member after the effective date of amendments constitutes agreement to the updated Guidelines. If a member does not agree, their sole remedy is to discontinue participation.

15. Regulatory Compliance & Legal Cooperation

15.1 Compliance with Applicable Laws and Regulations

All Community activities must comply with applicable laws and regulations, including those enforced by the SEC, FINRA, and FTC.

15.2 Cooperation with Law Enforcement and Regulators

The Company may cooperate fully with law enforcement or regulatory agencies, including disclosure of user information, communications, and activity logs as required or permitted by law.

15.3 Regulatory Reporting Rights

The Company may report suspicious activity to authorities without notice, including suspected market manipulation, investment solicitation, insider trading, or financial fraud.

15.4 No Protection Against Legal or Regulatory Action

Membership does not provide protection or immunity from legal, regulatory, or law enforcement actions. Members are solely responsible for their conduct and compliance with law.

15.5 Cooperation Obligations of Members

Members agree to cooperate fully with any lawful investigation initiated by the Company, law enforcement, or regulators related to their conduct. Failure to cooperate may result in immediate suspension or termination without refund.

16. Acknowledgment & Electronic Acceptance

16.1 Binding Effect of Acceptance

By joining, accessing, or participating in the Community, members acknowledge they have read, understood, and agreed to be legally bound by these Guidelines and all incorporated policies.

16.2 Electronic Signatures and Records

Electronic acknowledgment (including clicking "I Agree," checking a box, or accessing the Community after presentation of these Guidelines) constitutes a legally binding electronic signature.

16.3 Evidence of Agreement

The Company may maintain records of acceptance, including electronic acknowledgments, timestamps, platform access logs, Discord logs, IP addresses, device identifiers, payment records, and associated account information, which shall be admissible evidence in any legal, regulatory, or arbitration proceeding.

16.4 Continued Participation as Ongoing Consent

Each access or participation reaffirms agreement to these Guidelines and any updates. If a member does not agree, their sole remedy is to discontinue participation.

16.5 Survival of Obligations

Obligations relating to liability waivers, indemnification, intellectual property, regulatory compliance, dispute resolution, confidentiality of proprietary materials, and any provisions intended to survive termination remain in full force after access ends.
